General description
Conditional prohibition of the export of certain pharmaceuticals
National legal basis
Regulations Amending Certain Regulations Concerning Drugs and Medical Devices (Shortages) entered into force on November 27, 2021.

Le Règlement modifiant certains règlements visant les drogues et les instruments médicaux (pénuries) est entré en vigueur le 27 novembre 2021.
Administrative mechanism
These Regulations are based on the Interim Order Respecting Drug Shortages (Safeguarding the Drug Supply) made on November 27, 2020.

These Regulations do not prohibit exports but provides the Minister of Health the authority to prohibit a sale of a drug intended for the Canadian market for consumption outside Canada if it would cause or exacerbate a shortage of certain categories of drugs.

The distribution of drugs intended for the Canadian market for consumption outside of Canada continues to be permitted in cases where the seller determines that the sale will not cause or exacerbate a shortage.
